Sri Lanka massacred up to 40,000 Tamil civilians – former UN official

Sri Lanka’s military massacred as many as 40,000 Tamil civilians in the final onslaught against the Liberation Tigers in 2009, according to a former United Nations official with detailed knowledge of events, press reports said. The former United Nations’ spokesperson in Sri Lanka, Gordon Weiss, has resigned from the UN after 14 years and returned home to Australia, where he was interviewed by ABC News. “He’s now free to speak openly about the situation in Sri Lanka, for the first time and does so candidly and unflinchingly,” the media agency said.


“About 300,000 civilians, plus the Tamil Tiger forces, were trapped in an area of territory about the size of Central Park in New York,” says Weiss.

“They were within range of all the armaments that were being used, small and large, being used to smash the Tamil Tiger lines … the end result was that many thousands lost their lives.”

Gordon Weiss says his information comes from reliable sources who had a presence inside the battle zone, not Tamil civilians or fighters.

"The Sri Lankan government said many things which were either intentionally misleading, or were lies", Weiss told ABC’s reporter Eric Campbell.

Weiss says that after the war ended, a senior civil servant openly admitted that the authorities had deliberately underestimated the number of trapped civilians “as a ploy to allow the government to get on with its business.”

Soon after Sri Lanka’s declared victory over the LTTE in May 2009, the British newspaper, The Times, concluded an extensive investigation into the last days of the offensive and confirmed that up to 20,000 Tamil civilians were slaughtered.

Pointing out that not only the United Nations but several Western governments knew of the ongoing slaughter of Tamil civilians by the Sri Lanka Army, but kept silent for fear of upsetting the Colombo Government, The Times also demanded international action to prevent further atrocities.

“Such a monstrous collusion in covering up an atrocity must not go unchallenged. If the UN Human Rights Council refuses to investigate what has happened, the West must do so forthwith,” the paper said in an editorial.

“The silence of those who were warned of civilian deaths in Sri Lanka is shameful. They must speak out now to prevent future atrocities,” the editorial charged.

Development and Context of Eelam National Liberation


While Eelam National Liberation captures the emotions of most Eelam Tamils and even World Tamils, there are many outsiders and even some Tamils who do not have a clear understanding of it. Unless all the emotions resonate, they also could be counterproductive. Resonance in nature takes place when the induced frequency is the same as the natural frequency. In social life also, ideas become a material force if masses accept them as their own. This becomes possible only when Development of ideas match the Context. Both Development and Context imply Change.

If one avoids both ends to avoid speculation of the unknown, Evolution is a series of changes based on survival determined by resistance. It is a cause and effect frame and not a time frame. Evolution of man is based on collectivism, language and technology. When collectivism, language and technology interacted to reach an advanced mode of production called capitalism, evolution of Nations began. Thus a Nation is defined as a historical evolution of a community based on distinct territory, language, technology (economy) and culture. This period corresponded to about 12th, 13th centuries and it is to be noted that till about 1000 AD, earth’s resources were enough to provide for independent individual or tribal living. The Industrial Revolution facilitated the development of capitalism and the uneven distribution of resources resulted in uneven development of capitalism. Stronger Nations captured weaker Nations including Eelam and Sinhalam to be exploited for obtaining raw materials and for selling manufactured goods. The first phase of globalization in the form of advancing imperialism was completed when the whole world was shared between the imperialist powers and the first and second world wars were about redistributing the colonies. The resistance to this globalization produced the Russian Revolution of 1917 which developed to the extent of being the major player in ending the Second World War. Added to this the emergence of China after the war was a warning bell to the imperialist powers and the “free for all” oppression became a conscious planned oppression.

Countries whose borders were drawn without any consideration to the Nations constituting those countries, were given “independence” often without a struggle as in the then “Ceylon” and political power was transferred to the dominant Nations of the countries while the economic power was retained by the imperialist powers. It is to be noted that imperialism has been divided with the political component mainly in the hands of dominant Nations of countries with the economic component in the hands of the former imperialist powers. Thus the foundation was laid for the dominant Nations with State power and other Nations without State to enter into civil wars while the economic domination of the world continues with least resistance. Is it any wonder that the dominant Nations of India, Pakistan, China and indeed the entire third world develop a bond with the Government of Sri Lanka whose dominant Nation is Sinhalam? Is it not foolishness on the part of Eelam Tamils to expect justice from the Western governments who masterminded the conflicts in their own interest or from Delhi, Beijing and similar whose dominant Nations have oppressed other Nations in varying degrees? Of course these centers of power have contradictions among themselves and we need to make use of them but we cannot do that by tailing behind any power and more importantly we should have a strong friendly alliance with all oppressed Nations without State and other oppressed peoples.

The conscious plan for oppression by the imperialism did not stop with the above design alone. They knew that the power of the Socialist Countries (it was not Socialism but State Capitalism with better income distribution) need to be curtailed. They succeeded by undermining the bureaucracy of the Socialist countries by various carrot and stick methods and promoting the Globalization of capital. The dominance of the globalised capital is indeed the second phase of globalization. Thus the “free market capital” of the imperialist countries joined hands with the State capital of the Socialist countries under globalised capital and during the first Iraq war, a unipolar world was established and the Bipolar world of the cold war days was history. A unipolar world with full of contradictions is unstable and by the time of the second Iraq war a multi polar world was emerging. The environmental crisis and the current economic recession have made the multi polar world irreversible. More of the multi polar powers are outside the West which is certainly a declining force. In a multi polar setting, we should have relationship with all powers but should not tail behind any power and certainly not behind the declining one. Also the neighboring power could be more dangerous due to proximity which the Vietnamese realized in time. But the multi polar setting is certainly good for the smaller ones and in particular to the Nations without State.

The Eelam National struggle started as a peaceful political resistance as soon as the Sinhalam began to exercise the political imperialism it got from the imperialists and demonstrated with depriving citizenship to one million Tamils and with the colonization of the Tamil homeland. The peaceful resistance was suppressed for 30 years violently by State terrorism and chauvinist hooliganism with regular racial riots ignored by the international community but intensifying all the time resulting in armed resistance. The armed resistance was initially a reaction to the chauvinist ethnic hooliganism and state terrorism and naturally the resistance had similar dimension but soon developed as a Liberation movement and the targets were confined to economic and military targets. However though this transformation placed the LTTE on the wrong side of the West and India, the reliance of the traditional Tamil political leadership on the West and India, gave the wrong impression of the Liberation movement to the rest of the world. A situation arose when the west and India banned the LTTE and stopped supplies while the rest of the world (though did not block supplies to LTTE) politically took the side of the government of Sri Lanka. Thus the Liberation movement became friendless in the external world except Diaspora (whose hands were tied) support and this led to the defeat of the LTTE by the government of Sri Lanka with the backing of 20 powerful governments.

TNA and Diaspora should not make the same mistake again though the timeframe for the next phase of the Liberation struggle cannot be defined. The Presidential election 2010 has shown clearly that even semi devolution of power (not to mention recognition of the right of Self Determination) is unlikely by negotiation. Now that the sharing of spoils of war has been decided locally, the international powers will be concerned with their shares and not the well being of Eelam Tamils.

The Right of Self Determination of Eelam Tamils is naturally linked with the right of Self Determination of all Nations without State which are claimed to number around 3000 to 9000 but two hundreds and ten of them have been well documented in a book published by James Minahan (compare with 192 countries in UN). The recognition of the right of Self Determination of all Nations in the world is the next major Destination on the critical path (need to be achieved to move towards other subsequent Destinations) of civilization eliminating oppression of Nations by other Nations. However this does not eliminate other forms of oppression. National Liberation is essentially a Political Process (guaranteeing political power to the Nation) to be followed by Economic Liberation ending economic oppression and establishment of a Socialist Society which is a further advancement in the interaction among Collectivism, Language and Technology. Further interaction would lead to Communism and Fellowship of beings and things leading to the contradiction free Destination of Merger as One, the ultimate expression of collectivism. Even if there are disagreements about subsequent Destinations including “ultimate” Liberation but if there is agreement about the nearest Destination we should unite with all such agreeable forces. If Socialists, Communists, Spiritualists including Liberation Theologists agree on the question of National Liberation, then we should develop unity and solidarity with all of them.

The immediate physical survival of Eelam Tamils (who are either IDP’s or in open prison under occupation) and the ultimate recognition of the right of Self Determination are twin priorities. The sixty year struggle of Eelam Tamils is silenced for the time being and it is the duty of the Diaspora to assist in reducing that “time being”. The Diaspora is living in multicultural countries and has to fall in line with the laws of those countries but have a stake in the Eelam Tamil Nation as well as the Tamilnadu Tamil Nation (the only Tamil Nations in the world) because they are the sources of multi culturalism of the Diaspora. National Development and governance is possible only in these two Nations with territories historically. There is no room for transnational government but a strong and powerful world body is urgently needed. The GTF should fulfill this need and if those in charge cannot deliver, they should let others. If you can neither lead nor follow, please get out.

The Importance of Recording Contemporary History

India and Sri Lanka have been inhabited by Thamils from the beginning of recorded history. The ancient history of Thamil Nadu dates back to about 6000 years and their origin is topic of debate related to the Aryan invasion theory. This theory espouses the view that the Thamils belong to the Dravidian race and were part of the early Indus Valley settlers. Later with the advent of the Aryan invasion the Dravidians were forced to move Deep South where they ultimately settled. The present day states of Thamil Nadu, Kerala, Karnataka and Andhra Pradesh constitute the Dravidian culture. Kerala where Thamil Chera kings ruled lost its identity due to influx of Brahmins from the North.

The Thamils were seafaring people. They traded with Rome in the days of Emperor Augustus. They sent ships to many lands bordering the Indian Ocean and with the ships went traders, scholars and a way of life. The island of Ceylon which was separated from the Indian subcontinent by less than 30 miles of water was not unknown to the Thamils who called it Eelam.

Thamil Sangam literature dating from the 1st century BC to 2nd century AD speaks of three ruling families in India: the Cholas, the Pandyas and the Cheras.
South India was divided into several broad geographical-cum-cultural zones, known as Nadus.

During the later half of 4th century, Pallavar the great temple builders emerged into prominence and dominated the South for another 400 years. A large part of Thamil Nadu was ruled by then with Kanchipuram as their capital. In the 6th century they defeated the Cholas and extended their rule as far as Ceylon. Among the greatest Pallavar rulers were Mahendravarman l and his son Narasimhavarman. Dravidian architecture reached its epitome during Pallavar rule. The last Pallavar King was Aparajitha. He was defeated by Aditya Chola towards the end of the 9th century.

The basin of the Kaveri River became the Chola heartland known as Chola Nadu. Pandi Nadu was ruled by Pandya monarchs with Madurai the capital. Kongu Nadu in and around Coimbatore was at times in the hands of the Cheras of Kerala along the western Malabar Coast and at times controlled by the rulers of the Thamil region. At the height of Chola power between 1000 and 1100 the Chola empire encompassed all these regions.

Under Rajaraja Chola 1 and his son Rajendra Chola 1, the Cholas again rose as a formidable power in the 9th century in South India. The Chola empire extended to the central Indian states like Orissa and parts of West Bengal. Rajaraja Chola 1 conquered the eastern Chalukya kingdom by defeating the Cheras and also occupied greater part of Ceylon by defeating the Pandyas. Rajendra Chola 1 went beyond occupying the islands of Andaman and Nicobar, Lakshadweep, Sumatra, Java, Malaya and the islands of Pegu with his fleet of ships. He defeated Mahipala, the king of Bihar and Bengal, and to mark his victory he built a new capital called Gangaikonda Cholapuram. The Cholas started losing their power around the 13th century.

As Cholas declined, the Pandyas once again emerged as a power in the early 14th century. But this was short lived and soon they were subdued by Muslim Khilji invaders from the north in 1316. The city of Madurai was plundered and completely destroyed. The invasion destroyed the Chola and Pandya dynasties and led to the establishment of Bahmani Kingdom in the Northern Deccan.

Due to the 14th century invasion the Hindus retaliated and rallied to build a strong new kingdom called the Vijayanagara empire. This empire included all the strongholds of Cholas and other local Hindu rulers to check the Muslims. Governors called Nayakars were employed to run different territories of the empire. Vijayanagar empire was the most prosperous dynasty in the south with Hampi as the Capital. But by 1564 the empire came to an end at the hands of Deccan sultans in the battle of Talikota. The empire dismantled into many parts and was given to the Nayakars to rule. Thamil Country under the Telugu Nayakars was peaceful and prosperous. The Nayakars of Madurai and Thanjavur were most prominent of them all, who reconstructed some of the oldest temples in the country.

The Dutch accomplished a settlement in Pulicat around 1609. The British, under the British East India Company established a settlement further south, in present day Chennai, in the year 1639. The British took advantage of the petty quarrels among the provincial rulers (divide and rule) to expand their area of power.

The British fought with the various European powers, notably the French at Vandavasi (Wandiwash) in 1760, and the Dutch at Tharangambadi (Tranquebar), driving the Dutch away entirely and reducing the French dominions in India to Pondicherry. The British also fought four wars with the Kingdom of Mysore under Hyder Ali and later his son Tipu Sultan which led to their eventual domination of India's south. They consolidated southern India into the Madras Presidency.

During the rule of the Cholas in the eleventh century, the Thamils living in the Island of Ceylon were able to consolidate their positions in the militia and the administration of the court. It may be assumed that more Thamils settled in the northern region during this period.

In 1215 AD, Magha of Kalinga conquered the Sinhalese kingdom with its capital in Polonnaruwa with the help of Dravidian soldiers. This invasion weakened the Sinhalese power to such an extent that any semblance of political unity in the Island disappeared.

After Magha, the Javakas led by Chandrabhanu came to power with the help of Thamil soldiers from South India and ruled over most of the territory that were previously under Magha. Chandrabhanu became almost a vassal of the Pandyas and was overthrown by them when he refused to send tribute.

The centre of power of the Northern Kingdom was the Jaffna Peninsula and hence it was known by the name of the Kingdom of Jaffna. Ibn Battuta, the Arab traveler who visited the capital in 1344 AD states that the Thamil King's power extended up to Puttalam and that he was in control of the pearl fishery.

In the middle of the fourteenth century, the army of the Thamil King had penetrated as far south as Gampola and had driven the reigning Sinhalese King from his capital.

Under the Vijaya Nagara empire of South India the Thamil kingdom became its tributary and there followed a protective relationship. After its decline, Jaffna came under the sway of Thanjavur and Madurai, two centres of power that succeeded the former empire.

The following are the names of the Kings and their period of rule of Jaffna Kingdom –

1. Kalingaman alias Koolangai Singai Aryan alias Kalinga Vijeyabahu (1215 to 1240)
2. Kulasegara Pararajasegaram (1240 to 1256)
3. Kulothungan (1256 to 1279)
4. Vikramnan (1279 to 1302)
5. Varothayan (1371 to 1380)

6. Marthanda Perumalan (1325 to 1348)
7. Kunapooshanan (1348 to 1371)
8. Virothayan (1371 to 1380)
9. Jeyaveeran (1380 to 1410)
10. Kunaveeran (1410 to 1446)

11. Kanagasooriyan (1446 to 1450). From 1450 to 1467 Jaffna Kingdom came under the rule of Kotte kingdom. Troops under the command of Chenpakap Perumal captured Jaffna. He was a Chera prince and adopted son of Parakramabahu V1 of Kotte. Later he became King of Kotte under the name of King Bhuvanekabahu VI. Kanagasooriyan fled to Thamil Nadu and came back with an army and re-captured the Kingdom and again ruled from 1467 to 1478.
12. Pararajasegaran (1478 to 1519)
13. Sankili Segarajasegaran (1519 to 1561). He was born to the third wife of Pararajasegaran.
14. Pararasa Pandaram, Pararasasekaran (1561 to 1565). Son of Sankili.
15. Kurunchi Nainar (1565 to 1570)

16. Periapillai Sekarasa Sekaran (1570 to 1582)
17. Puvirasa Pandaram II (1582 to 1591)
18. Ethirmanna Singa Pararasasekaran (1591 to 1615). (Set up by the Portuguese)
19. Sankili Kumaran (1615 to 1619) (Nephew of Above)

The Kingdom came to end in 1619 when the Portuguese finally managed to defeat Sankili. He was captured and taken by the Portuguese to Goa where he was put to the sword. The Portuguese ruled Jaffna Kingdom from 1619 to 1658. The Dutch who captured the Kingdom from the Portuguese ruled till 1795 and the British till February 03,1948.

This is a brief snapshot of our history spanning more than 2,000 years. But sadly Thamils failed to record their history in the modern sense of the word. While the Thamils excelled in literature, architecture, fine arts etc. they lacked historical consciousness. They had no sense of time and did not create a calendar like the Romans. It is with the help of Sangam literature attempts are made to reconstruct history. However, there are gaping holes in between.

Thamils 1800 Years Ago by V. Kanagasabhai is the first attempt to write Thamils history in the modern sense of the word. This work is based on a series of articles published in Madras Review between the years 1895 and 1901 with the objective of bringing out all the information available in Thamil literature regarding the ancient civilization of the Thamils.

With a view to confine strictly to the subject of the book as shown in the title, the author has carefully avoided touching upon the history of the Thamils before AD 50 or after AD 150.

This book describes the ancient geography of the land of the Thamils, their foreign commerce, the different races that spoke Thamil, their political history, and concludes with an account of their social life, mode of warfare, literature, philosophy and religion. Many historical works by prominent historians followed later.
The conflict between the Sinhalese and Thamils took a turn for the worse when Sinhala Only was declared the official language of Ceylon in June, 1956.

A peaceful protest by Thamil leaders at Galle Face green by Thamil leaders were attacked by Sinhala goons and broken up. Ceylon witnessed its first ethnic clash since independence when Thamil civilians were set upon by Sinhalese mobs. This was followed up with a series of ethnic clashes between the Sinhalese and Thamils in 1958, 1977, 1979, 1981 and 1983.

Massacres of Thamils is a chronology of Events covering the period 1956 – 2008

This book painstakingly records massacres that occurred between 1956 – 2008 from first hand information. Although the book is by no means complete the compilers have done a commendable job recording part of contemporary history without leaving it to future historians. Our gratitude is due to all individuals and institutions who laboured hard under trying conditions to compile this book.

These massacres were carried out by the Sinhala armed forces ably aided and abetted by racist Sinhala politicians. The genocidal war against the Thamil people has killed more than 100,000 Thamils since 1956. In the last phase of the Eelam War IV (May, 2009) 25,000 civilians died and twice that number were seriously injured. Sadly some among them are some of those who worked on this project.

Rev. Fr. M.X.Karunaratnam who functioned as the Chairman of the NorthEast Secretariat on Human Rights (NESOHR) was killed in a Claymore attack carried out by the Long Range Reconnaissance Petrol (LRRP) of the Sri Lanka Army on April 20, 2008 in Vanni.

The very first massacre deals with what took place in Inginiyakala on June 05, 1956 in the aftermath of the Sinhala Only bill passed in the parliament. This was the commencement of Sinhala mob terrorism against unarmed Thamils. The police was ineffective and remained mute spectators.

The book goes to record in detail a further 156 massacres giving detail account of names of victims, occupation and age.

The preface has been written by the well known Thamil activist Dr. Ellyn Shander MD. The book has been published by Manitham Publishers (www.manitham.net) the well known human rights organization based in Chennai. Thamil Nadu.

Inginigala is one of several Sinhalese settlements created under the Gal Oya (Paddippalai) Development scheme in the Amparai District. State sponsored Gal Oya Development scheme and Allai – Kanthalai in the Trincomalee district were major Sinhala colonization schemes in the early fifties that altered the demographic composition of the eastern province. I was working at the Trincomalee Kachcheri (1957 -58) when Allai-Kantalai scheme was nearing completion. This state aided colonization scheme reduced the status of Thamils in the eastern province from majority to minority. It created two additional electoral districts one in Trincomalee (Seruwila) and one in Batticaloa (Digamaduwa) district

The sinister plan of the Sinhala government is to make Sinhala people the single largest ethnic group in the Eastern Province. The temporary merged North and East has been de-merged in 2008 following a court order.

The master plan by the government in Colombo envisaged demographic changes through state aided settlements, tourism development and a Buddhist revival in Amparai District and agro-business promotion in the Thoppigala areas in Batticaloa District.

Population statistics will help to illustrate how demography patterns have been unnaturally altered or distorted through state aided colonisation, demarcation of new political and administrative units and accelerated irrigation schemes in the Eastern Province.

The Eastern Province is 3,839 sq. miles in extent. Originally Trincomalee 1,016 sq. miles and Batticaloa 2,823 sq. miles were the two districts in this province. According to the 1921 census, the Sinhalese were 3% of the population in the Trincomalee District and 4.5% in the combined Batticaloa and Amparai District. The Sinhalese were less than 4% in the whole of Eastern Province.

The Batticaloa District was divided into the present Amparai District 1,775 sq. miles and Batticaloa District 1,048 sq. miles in 1961. The following Table shows the demographic changes between 1881 – 1981 which is self explanatory.


Thamil population increased from 146,059 to 409,451 - 302%, Muslim population increased from 109,024 to 315,201 - 289%, Sinhalese population increased from 27,556 to 243,358 - 883%. The National average increase of Sinhalese during this period is only 238%. The sudden increase of Sinhala population is the result of Government planed Sinhala Colonisation in Gal-Oya, Pannal- Oya, and Ambalam- Oya in Amparai District, and Kanthalai - Allai, Morawewa, Muthalikkulam, Pathaviya and Mahadiuluwewa schemes in Trincomalee District.

We hope this book will give both Thamils and Non-Thamils an insight about the state violence unleashed against Thamils by a government bent on undisguised genocide. Thamils have experienced nothing but death, destruction, disappearances since independence.

The just concluded Eelam War IV had proved beyond any doubt that co-existence between the majority Sinhala-Buddhists and Thamils is not a possibility under a single polity. They are like dry and wet clay that will never stick together.

Any solution to the ethnic conflict should be anchored on the following historical and landmark resolution, mandate and principles.

1) The Vaddukkoddai Resolution adopted at the first National Convention of the Thamil United Liberation Front (TULF) on 14 May 1976. In this Resolution, the TULF declared its intent of forming a Free, Sovereign State of Thamil Eelam based on the right of self determination inherent to every nation.
2) The Mandate given to the TULF at the general elections held in 1977.
3) The Declaration at the Thimbu talks that any meaningful solution to the Thamil national question must be based on the following four cardinal principles:

· recognition of the Thamils of Ceylon as a nation
· recognition of the existence of an identified homeland for the Thamils of Ceylon
· recognition of the right of self determination of the Thamil nation
· recognition of the right to citizenship and the fundamental rights of all Thamils of Ceylon

It is now our historical duty to carry forward the sacred fight for freedom and not rest till the goal of a sovereign state of Thamil Eelam is reached.

Massacres of Tamils 1956 – 2008 is a constant reminder the precious lives lost and blood spilled should not be in vain. Aptly the book has been dedicated in memory to the thousands of Thamils who lost their life at the hands of the Sri Lankan State armed forces.

SNE Thanked NESoHR and Manitham in attempt to document 61 Years Tamil Massacres in Sri Lanka

Statistical center for North East (SNE) thanked for NESHoR and India based "Manitham" human rights organisation on the publication of the book in several languages on 61 years large scale Massacres of Tamils in NorthEast of Sri Lanka, SNE release said.

Statistical center for North East (SNE) and NESoHR worked together in the recording of 61 Years Tamil Massacre in NorthEast of Sri Lanka. After the hard attempt of SNE, was able to released the report "Lest We Forget Part 1" at the end of 2007 and the next report "Lest We Forget Part 2" on July 2008. But the two reports only included the massacres which had been occurred before 2005.

Manitham human rights organisation has come forward to publish the two reports with some updates until the end of 2008 as a book in several languages. In this effort NESoHR is supporting "MANITHAM" and working with them on publication.

The release date for the book to be in December 2009.

SNE is still in active on the recording of Human rights violation against Tamil minority in NorthEast, should be noted.

The SNE release states:

The State sponsored violence against the Tamil people in the island of Sri Lanka mainly in NortEsat, has a very long history. SNE was established in middle of 2003, in order to record all Massacres in North East of Sri Lanka after the it's independence. The data collection project was started in middle of 2003 follwoing the ceasefire agreement between Sri Lankan government and LTTE. CFA allowed relatively free access to all areas of Northeast and SNE was able to recorded all events with the co-operation of Tamil interlectuals in North East.

Data collection permission was obtained from the District Secretariat (Kachcheri) and the help of the Grama Sevakar was sought to ensure all households were covered. The project was presided by Graduates from NorthEast and data collection team formed for each villages, containing University students and A/L students from North East, had performed a unique visit to each house to ensuring no household in the village is missed in the data collection.

Professors, lecturers and Tamil Diaspora human rights activists advised us on our communication strategy before and during the data collection and provided the vital information about the massacres and related photos kept with them for long period. We also received the evidence of massacres from Journalists, Sri Lankan government staffs, Library officers and several individuals who had been interested on the documentation of Tamil Massacres. Many of those involved in the data collection were received death threat by the Sri Lankan security forces in several occasion. The death threat appears aimed at pressuring the team to stop the recording of massacres in NorthEast. even the teams were actively involved and successfully finished the survey in time. We are thanking those who had supported us in several ways to document the Tamil Massacre in NorthEast of Sri Lanka.

At this time we remember that those who had been working with SNE, were killed in the last stage of war and several were disappeared or killed after screening process by the Sri Lankan security forces with the help of Govt backed para military.

Trinco executions added to Sri Lanka's war crimes record in Dublin

An affidavit containing the personal testimony of Dr Manoharan, the father of Ragihar, one of the five high school students shot dead in execution style in Trincomalee beach nearly four years ago by members of Sri Lanka security forces, and two detailed reports of evidence collected on the killings by a Rights Group whose members are in self-exile due to threat to their lives, were submitted as record of evidence to the Dublin war-crimes tribunal hearing concluded on the 16th of this month, US-based pressure group Tamils Against Genocide (TAG) said Tuesday.

Dr Manoharan and the surviving members of the family were relocated to UK with the assistance of a UN organization after the killings to escape intimidation by the Sri Lanka security forces against Dr Manoharan legally pursuing the killers of his son.
The report documents the names and the date of birth of the five students killed on 2nd January 2006 in Trincomalee, a big harbor town under the control of and heavily garrisoned by the Sri Lanka security forces, as:

Dr Manoharan's affidavit details the events of 2nd January 2006 from the time Ragihar left his home at 6:00 p.m. to visit the Ganesha temple to attend the Hindu's customary festival during new year fasting, the hearing of explosion at around 7:35 p.m., Ragihar's call to his father on the cell phone informing him that soldiers were around him, desperate and failed attempts to get through the checkpoint to see if his son was there near the Gandhi statue, to the time he identified Ragihar's body in the hospital.
he affidavit further describes the interaction with the security forces and the attempt by Minister of Human Rights Mr Samarasinghe in April of 2006 offering Dr Manoharan family a "nice house in Colombo," "a nice school" for his children, encouraging him to "move on after the incident."

The report identifies Superintendent of Police, Kapila Jayasekere, naval officer Udawatte Weerakody, "leader of the killer team" Vas Perera, DIG Abeywardena, and DIG and JHU member HMGB Kotakadeniya as culpable individuals for the crime among other higher level officials, military and political, who bear command responsibility established by the Hague Conventions IV (1907) and X (1907) for war crimes.

Two complete investigative reports dated 19th April 2007 and 2nd January 2010 and produced by UTHR, a Rights Group in Sri Lanka whose members are in exile, were included in the submission to provide the tribunal judges a full account of information available on the alleged war-crime by Sri Lanka security forces.

Sri Lanka: A Bitter Peace

OVERVIEW

Since the decisive military victory over the Liberation Tigers of Tamil Eelam (LTTE), Sri Lanka has made little progress in reconstructing its battered democratic institutions or establishing conditions for a stable peace. Eight months later, the post-war policies of President Mahinda Rajapaksa have deepened rather than resolved the grievances that generated and sustained LTTE militancy. While the LTTE’s defeat and the end of its control over Tamil political life are historic and welcome changes, the victory over Tamil militancy will remain fragile unless Sinhalese-dominated political parties make strong moves towards a more inclusive and democratic state. The emergence of retired General Sarath Fonseka to challenge Rajapaksa in the 26 January presidential election has opened new space to challenge repressive government policies. But neither has offered credible proposals for political reforms that would address the marginalisation of Tamils and other minorities. Whoever wins, donor governments and international institutions should use their development assistance to support reforms designed to protect the democratic rights of all of Sri Lanka’s citizens and ethnic communities.

The government’s internment of more than a quarter million Tamils displaced from the Northern Province – some for more than six months – was further humiliation for a population brutalised by months of ferocious fighting. The return by the end of 2009 of most of the displaced to their home districts, and the increased freedom of movement for the nearly 100,000 still in military-run camps, are important steps forward. However, the resettlement process has failed to meet international standards for safe and dignified returns. There has been little or no consultation with the displaced and no independent monitoring; many returns have been to areas not cleared of mines and unexploded ordnance; inadequate financial resources have been provided for those returning home; and the military continues to control people’s movements. These and other concerns also apply to the estimated 80,000 Muslims forcibly expelled from the north by the LTTE in 1990, some of whom have begun to return to their homes.

The UN and donor governments should insist more strongly that all resettlement is done according to established guiding principles. Donors should end assistance to any camps where full freedom of movement is not allowed and condition additional aid on an effective monitoring role for UN agencies and NGO partners. India, Japan, Western donors, the World Bank and the Asian Development Bank should tie additional development assistance to an inclusive and consultative planning process for the reconstruction of the north. Access by the International Committee of the Red Cross (ICRC) to the more than 12,000 Tamils held in irregular detention centres on suspicion of ties to the LTTE is also essential.

The government’s approach to the development and reconstruction of the north and east is contributing to minority fears and alienation. Government plans remain unclear, with local communities and political leaders not consulted and even donors not informed of overall reconstruction plans. Strong military influence over policies, tight military control over the population and restrictions on local and international NGOs increase the risk of land conflicts, with the strong possibility of demographic changes that would dilute the Tamil character of the north. No real space has been given to Tamil and Muslim political or community leaders in the north and very little in the east.

The Rajapaksa government has initiated no political reforms to address Tamil and other minorities’ concerns. The government-sponsored All Party Representative Committee (APRC) designed to craft constitutional reforms has in effect ended with no sign of an alternative process. Tamil and Muslim parties remain weak and divided, although recent encouraging initiatives to develop a common platform and build trust among Tamil-speaking parties deserve support. Inside and outside Sri Lanka, many Tamils remain angry at the lack of accounting or justice for the thousands of civilians killed in the final months of the war. Most of the million-strong diaspora is still committed to a separate state and many would be willing to support renewed violence.

The brutal nature of the conflict, especially in its closing months, has undermined Sri Lanka’s democratic institutions and governance. All ethnic communities are suffering from the collapse of the rule of law. Disappearances and political killings associated with the government’s counter-insurgency campaign have been greatly reduced since the end of the war. Impunity for abuses by state officials continues, however, and fear and self-censorship among civil society activists and political dissidents remain widespread. Rajapaksa’s government continues to maintain and use the Prevention of Terrorism Act and Emergency Regulations to weaken its political opposition.

The campaign of retired General Sarath Fonseka has put the Rajapaksas on the defensive and united a long-dormant opposition. Alleging corruption and other abuses of power by the Rajapaksa family, Fonseka and the parties supporting him promise major reforms, including the end of emergency rule and the abolition of the Executive Presidency itself. However, Fonseka’s candidacy suffers from contradictions and poses grave risks. Promises made to Tamil parties to restore civilian control over land policies and the resettlement process in the north threaten to put Fonseka at odds with his allies in the military and run directly counter to Fonseka’s consistently Sinhala nationalist policies over the course of his career. The numerous allegations that General Fonseka was involved in attacks on journalists and other human rights violations undermine his calls for reforms and an end to impunity. It remains an open question whether the ideologically diverse set of parties that have endorsed Fonseka will be able to work together or influence his policies should he win.

International actors need to press for accountability for abuses by both sides during the war as well as challenge the government’s post-war policies. Numerous states with insurgencies have begun to look at Sri Lanka as a model. India and Western governments may yet come to regret giving Sri Lanka the green light – and even assisting it – to fight a “war on terror” prior to the government agreeing to political reforms or showing any commitment to the rule of law, constitutional norms or respect for human rights. The precedent can and should be challenged. Donors should condition further development assistance on governance reforms designed to curb impunity and make government accountable to citizens of all communities. This could eventually help open the space for Tamil and Muslim political leaders to organise effectively now that the LTTE is no longer there to control their agenda.

இலங்கை அரசியலில் ஜனாதிபதித் தேர்தல் ஏற்படுத்தி வரும் சுழல்காற்றை விட வேகம் மிக்க சூறாவளி ஒன்றை ஐக்கிய நாடுகள் சபை கடந்த வியாழக்கிழமை ஏற்படுத்தியுள்ளது.
இலங்கை இராணுவத்தினர் தமிழ் இளைஞர்களை சுட்டுக்கொல்லும் காட்சிகள் எனத் தெரிவித்து பிரித்தானியாவின் சனல் 4 தொலைக்காட்சி நிறுவனம் கடந்த ஓகஸ்ட் மாதம் வெளியிட்ட வீடியோ உண்மையானது என ஐ.நா.வின் நீதிக்குப் புறம்பான படுகொலைகள் தொடர்பான அதிகாரி பேராசிரியர் பிலிப் அல்ஸ்ரன் தெரிவித்துள்ளமை இலங்கை அரசாங்கத்தை மீளமுடியாத நெருக்கடிக்குள் தள்ளியுள்ளது.
அல்ஸ்ரனின் அறிக்கை வெளிவந்த சில மணிநேரங்களிற்குள் வெளிவிவகார அமைச்சர் ரோஹித போகொல்லாகம அவசர அவசரமாக அல்ஸ்ரன் மீது மேற்கொண்ட குற்றச்சாட்டுகளில் இருந்து அதன் தாக்கம் என்ன என்பதை உணர்ந்து கொள்ள முடியும்.
நாடுகளுக்கு இடையிலான இராஜதந்திர விதிமுறைகளை அல்ஸ்ரன் மீறிவிட்டதாக வெளிவிவகார அமைச்சர் ரோஹித போகொல்லாகம தெரிவித்துள்ளார். ஐக்கிய நாடுகள் இந்த விவகாரத்தை ஊடகங்களுக்கு தெரிவிப்பதற்கு முன்னர் எம்மை தொடர்பு கொண்டு நடைமுறைகளை பின்பற்றியிருக்க வேண்டும். சுயாதீன நிபுணர்களின் முடிவுகள் தொடர்பாக பிலிப் அல்ஸ்ரன் எம்முடன்தான் முதலில் தொடர்பு கொண்டு கேட்டிருக்க வேண்டும் என அவர் மேலும் தெரிவித்துள்ளார்.
ஆனால், அல்ஸ்ரனின் அறிக்கை தெளிவானது.
கண்கள் கட்டப்பட்ட நிலையில் இளைஞர்கள் நிர்வாணமாக இழுத்துவரப்பட்டு அவர்களை மண்டியிட வைத்து பின்தலையில் ரி56 ரக துப்பாக்கியால் சீருடையினர் சுட்டுப் படுகொலை செய்யும் காட்சிகளும், அதனை சுற்றி நிற்போர் பார்த்து ரசிக்கும் காட்சிகளும் உலகில் பரந்து வாழும் தமிழ் இனத்தை மட்டுமல்லாது உலகின் மனித சமுதாயத்தின் இத யங்களை உலுக்கியிருந்தது.
இந்த வீடியோ தொடர்பில் விசாரணைகள் நடத்தப்பட வேண்டும் என ஐ.நா. இலங்கை அரசாங்கத்தைக் கோரியிருந்தது.
விசாரணைகளின் முடிவில் வீடியோ பொய்யானது என இலங்கை அரசாங்கம் தெரிவித்த போதும் அதனை ஐ.நா. ஏற்றுக்கொள்ளவில்லை. அதற்கு ஐ.நா. சில காரணங்களையும் முன்வைத்துள்ளது. அதாவது, விசாரணைக் குழுவில் அங்கம் வகித்த மூன்று பேரில் இருவர் படை அதிகாரிகள் என்பதே அதுவாகும்.
அதனைத் தொடர்ந்து ஐ.நா.வின் நீதிக்குப் புறம்பான படுகொலைகள் தொடர்பான சிறப்புப் பிரதிநிதி பிலிப் அல்ஸ்ரன் தனது மேற்பார்வையில் மூவர் அடங்கிய குழு ஒன்றை நியமித்திருந்தார்.
காயங்கள் மற்றும் நோய்கள் தொடர்பான குற்றப்பிரிவு அதிகாரி கலாநிதி டானியல் ஸ்பிற்ஸ், காணொளி பகுப்பாய்வாளர் ஸ்பைவக், துப்பாக்கி பிரயோக தடயவியல் நிபுணர் பீற்றர் டியக்சு ஆகியோர் கடந்த நான்கு மாதங்களாக மேற்கொண்ட ஆய்வின் முடிவில் வீடியோ உண்மையானது என்பதை உறுதி செய்துள்ளனர்.
துப்பாக்கியின் பின்உதைப்பு, அதன் அசைவு, துப்பாக்கிப் பிரயோகம் மேற்கொண்டவரின் அசைவு, துப்பாக்கியில் இருந்து வெளிப்பட்ட வாயு என்பவற்றை ஆராய்ந்ததில் உயிர்க்கொல்லி சன்னங்கள் மூலம் துப்பாக்கிப் பிரயோகம் மேற்கொள்ளப்பட்டதை உறுதிப்படுத்தமுடியும் என பீற்றர் டியக்சு தெரிவித்துள்ளார்.
படுகொலை செய்யப்பட்டவர்களின் உடல் அசைவுகள், எதிர்த்தாக்கம், குருதி வெளியேறிய முறைகளை ஆய்வு செய்ததில் மேற்படி வீடியோ உண்மையானது என்ற முடிவுக்கு தான் வருவதாக கலாநிதி டானியல் ஸ்பிற்ஸ் தெரிவித்துள்ளார்.
பேராசிரியர் பிலிப் அல்ஸ்ரனை பொறுத்த வரையில் அவர் நியூயோர்க் பல்கலைக்கழ கத்தின் சட்டத்துறை கல்லூரியில் பேராசிரியராக கடமையாற்றியதுடன், அவுஸ்திரேலியா உட்பட பல பல்கலைக்கழகங்களில் சட்டவியல் பேராசிரியராக கடமையாற்றியவர். அனைத்துலக சட்டத்துறையில் நிபுணத்துவம் பெற்ற அவர் பொதுமக்களுக்கு எதிரான வன்முறைகள் தொடர்பில் பல சட்ட நூல்களையும் எழுதியுள்ளார்.
ஐக்கிய நாடுகள் சபையின் நீதிக்குப்புறம்பான மற்றும் எழுந்தமானமான படுகொலைகளுக்கு எதிரான சிறப்பு பிரதிநிதியாக 2004 ஆம் ஆண்டு நியமிக்கப்பட்ட பின்னர் ஆசிய, ஆபிரிக்க மற்றும் மத்திய கிழக்கு நாடுகளில் நடைபெறும் படுகொலைகள் தொடர்பில் அவர் அதிக அக்கறை காட்டி வந்துள்ளார். நீதிக்குப்புறம்பான படுகொலைகள் தொடர்பில் சட்டவிதிகளையும் அவர் வரைந்துள்ளதும் இங்கு குறிப்பிடத்தக்கது.
நியூயோர்க் பல்கலைக்கழகத்தின் சட்டத்துறையின் மனித உரிமைகள் மற்றும் உலக நீதி மையத்தினால் மேற்கொள்ளப்படும் செயற்றிட்டங்களின் தலைவராகவும் அவர் சாரா கினுக்கி என்பவருடன் இணைந்து பணியாற்றி வருகின்றார்.எனவே பிலிப் அல்ஸ்ரன் மீது சேறு பூசு வதோ அல்லது அவரை புலியாக்குவதோ எதிர்மறையான விளைவுகளைத்தான் கொண்டுவரும் என்பதை அரசாங்கம் உணர்ந்து கொண்டிருக்கும். மேலும் அண்மையில் ஐ.நா.வுக்கு எதிராக மேற்கொள்ளப்பட்ட அறிக்கைகளை இலங்கை அரசாங்கம் மீளப்பெற்றுக் கொண்டதும் நாம் அறிந்ததே.
இலங்கை தொடர்பான மேற்குலக மற்றும் ஐ.நா.வின் நடவடிக்கைகளை பொறுத்தவøரயில் சாண் இறங்குவது முழம் ஏறுவது என்ற கொள்கையைத் தான் பின்பற்றி வருகின்றன. (முன்னர் அவை சாண் ஏறுவது முழம் இறங்குவதையே பின்பற்றியிருந்தன). இது அவர்களின் கொள்கையில் ஏற்பட்ட மாற்றமாகவே நோக்கப்படுகின்றது. எனவே வெளியிலிருந்து பார்ப்பவர்களுக்கு ஐ.நா.வும், மேற்குலகமும் சில விடயங்களில் இலங்கை அரசாங்கத்திற்கு பணிந்து போவது போலவும், உதவிகளை மேற்கொள்ளப்போவது போலவும் தோன்றலாம்.
ஆனால், அவர்களின் பிடிகள் மெல்ல மெல்ல இறுகி வருவதைத்தான் அண்மைய சம்பவங்கள் மூலம் உணர முடிந்துள்ளது. பொருளாதார மற்றும் படைத்துறை உதவிகள், அபிவிருத்தி நடவடிக்கைகள் என்ற போர்வையில் இந்து சமுத்திர பிராந்தியத்தில் தமது ஆளுமையை வலுப்படுத்த சீனாவும் இந்தியாவும் முனைந்து வரும்போது மனித உரிமைகள் என்ற அஸ்திரத்துடன் மேற்குலகம் ஆசியப் பிராந்தியத்திற்குள் நுழையப்போகின்றது.
கடந்த வருடம் ஐக்கிய நாடுகளின் மனித உரிமைகள் ஆணைக்குழுவில் அமெரிக்கா முதன் முதலாக இணைந்து கொண்டதன் பின்னணியும் அதுதான். இலங்கையின் தற்போதைய அரசாங்கத்தைப் பொறுத்தவரையில் மனித உரிமை மீறல்கள் மற்றும் போர்க்குற்றங்கள் தொடர்பான விசாரணைகளை புறந்தள்ள முடியாத நிலைக்கு வந்துள்ளது. அவர்கள் அதனை எதிர்கொண்டே ஆகவேண்டும் என்ற வட்டத்திற்குள் தள்ளப்பட்டுவிட்டனர்.
இலங்கை அரசாங்கத்திற்கு மீண்டும் வலுவான ஆதாரம் ஒன்றை அல்ஸ்ரன் முன்வைத்துள்ளதாகவும், எனவே இலங்கை அரசாங்கம் மேற்கொண்ட போர்க் குற்றங்கள் தொடர்பில் விசாரணைகள் முன்னெடுக்கப்பட வேண்டும் எனவும் அனைத்துலக மன்னிப்புச்சபையும் கடந்த வெள்ளிக்கிழமை மீண்டும் கோரிக்கை விடுத்துள்ளது.எதிர்வரும் 14 மற்றும் 15 ஆம் திகதிகளில் 11 நீதிபதிகள் தலைமையில் அயர்லாந்தின் தலைநகரான டப்ளின் நகரில் ஆரம்பமாகவுள்ள இலங்கையில் மேற்கொள்ளப்பட்டதாகக் கூறப்படும் போர்க் குற்றங்கள் தொடர்பõன விசாரணைகள் என்பது ஒரு ஆரம்பமே எனவும் தெரிவிக்கப்படுகின்றது. மேற்குலகத்தினதும், ஐ.நா.வினதும் இந்த நகர்வுகளின் பின்னணியில் புலம்பெயர் தமிழ் சமூகத்தின் பங்களிப்புகள் அதிகரித்து வருவதும் தமிழ் மக்களுக்கு அனுகூலமானதாகவே அமைந்துள்ளது.
இதனிடையே அல்ஸ்ரன் மேற்கொண்ட அறிவித்தலும், ஐரோப்பிய ஒன்றியம் வெளியிட்ட அறிக்கையும் எதிர்வரும் 26 ஆம் திகதி நடைபெறவுள்ள ஜனாதிபதித் தேர்தலில் அர சாங்கத்துக்கு பாதகமான நிலையை உருவாக்கும் எனக் கருதப்படுகின்றது.
ஐரோப்பிய ஒன்றியத்தின் அறிக்கை தென்னிலங்கை மக்களின் பொருளாதாரத்தின் எதிர்காலம் தொடர்பாக பெரும் நம்பிக்கையீனத்தை ஏற்படுத்தியுள்ள அதே சமயம் அல்ஸ்ரனின் அறிவித்தல் அரசாங்கத்துக்கு ஆதரவு வழங்கும் அரசியல்வாதிகள் மற்றும் அரசியல் கட்சிகளுக்கு பல அச்சங்களை ஏற்படுத்தலாம்.
மெல்ல மெல்ல இறுகி வரும் மேற்குலகின் அழுத்தம் அரசாங்கத்தின் குரல்வளையை நெரிக்க ஆரம்பித்துள்ள நிலையில் எதிர்க்கட்சிகளின் பொதுவேட்பாளர் ஜெனரல் சரத் பொன்சேகாவுக்கான ஆதரவுகள் அதிகரித்து வருவதும் இலங்கை அரசியலில் பல மாற்றங்கள் ஏற்படும் சாத்தியங்களை அதிகரித்துள்ளது.
இந்த நிலையில் தமிழ் தேசியக் கூட்டமைப்பும் ஜெனரல் சரத் பொன்சேகாவை ஆதரிப்பதாக கடந்த புதன்கிழமை அறிவித்துள்ளது.அரசியல் தீர்வு மனிதாபிமான நெருக்கடிகளுக்கான தீர்வு என பல விடயங்களை முன்நிறுத்தி இந்த ஆதரவுகளை வழங்குவதற்கு தமிழ் தேசியக் கூட்டமைப்பு முன்வந்துள்ளது. கூட்டமைபின் இந்த முடிவானது சரியான சமயத்தில் எடுக்கப்பட்ட மிக நல்ல முடிவு. அண்மைக்காலத்தில் தமிழ் மக்கள் மேற்கொண்ட இராஜதந்திர நகர்வுகளில் தமிழ் தேசிய கூட்டமைப்பின் முடிவு ஒரு முக்கிய திருப்பமாகும்.
தமிழ் தேசிய கூட்டமைப்பின் முடிவுக்கு தமிழ் மக்களின் பிரதிநிதிகளான செயற்படும் சகல தமிழ் நாடாளுமன்ற உறுப்பினர்களும் ஆதரவு தரவேண்டும் என்பதே தமிழ் மக்களின் ஆவல். இலங்கையில் மேற்கொள்ளப்படும் ஒரு ஆட்சிமாற்றத்தின் ஊடாக தமிழ் மக்களுக்கு ஒரு அமைதியான சூழ்நிலையையும், அதன் அடுத்த நகர்வாக அரசியல் தீர்வுக்கான ஆரம்ப செயற்றிட்டங்களையும் முன்னெடுக்க முடியும்.
பூகோள அரசியல் முனைவாக்கத்தில் சிக்கிப்போயுள்ள இலங்கை அரசியலில் தமிழ் மக்கள் தமக்கான இடத்தை தக்கவைக்க வேண்டும் என்றால் தோற்றம்பெற்றுள்ள முனைவாக்கத்தை மேலும் வலுப்பெறச் செய்ய வேண்டும். மேற்குலகம், ஐக்கிய நாடுகள் இவற்றின் பிரவேசம் பிராந்திய வல்லரசுகளின் ஒருபக்க சார்புநிலை அரசியலின் மாற்றத்திற்கு மிகச்சிறந்த மருந்தாக அமையும்.
அதன் முதல் படி எதிர்வரும் ஜனாதிபதித் தேர்தலின் முடிவுகளைப் பொறுத்தே அமையப்போகின்றது. தமிழ் மக்களின் ஒருங்கிணைந்த பங்களிப்புடன் இலங்கையில் ஒரு முழுமையான ஜனநாயகத்தை செயற்படுத்துவதற்கு அனைத்துலக மனிதநேய அமைப்புக்களும், மேற்குலகமும் சந்தர்ப்பம் பார்த்து காத்திருக்கின்றன.

முள்ளிவாய்க்காலில் நடந்து முடிந்தது ஓர் சோகக்கதையா அல்லது சோகத்தின் நடுவில் தலைநிமிர்வா?


கடந்த வருடம் தமிழினத்திற்கெதிராக இலங்கை, இந்தியா மற்றும் பல உலகநாடுகள் அனைத்தும் ஒன்றுசேர்ந்து தொடுத்த முள்ளிவாய்க்கால் போரில் எற்பட்ட மனித அவலங்களாலும் அதன் தாக்கத்தாலும் ஏற்பட்ட அதிர்ச்சி, சோகம், மனத்தளர்ச்சி ஆகியவற்றை தமிழீழத்திலும், உலகம் முழுவதும் புலம்பெயர்ந்து வாழும் ஈழத்தமிழர்களது மனங்களிலிருந்து என்றென்றும் அழித்தொழிக்க முடியாது.


முப்பது வருடங்களுக்கும் மேலாக இலங்கையரசையும் அதன் ஆட்சியாளர்களையும் உறக்கமின்றி திகைக்கவைத்தது மட்டுமன்றி, உலகநாடுகள் பலதும் பொருளாதார, ஆயுத மற்றும் படையுதவிகளையும் செய்து பராமரித்து வந்த இலங்கையின் இராணுவத்தை நிலைகுலையச் செய்த வீரம் செறிந்த ஒரு இயக்கத்தைப் பற்றி, இன்று பல்வேறு ஊடகங்கள் தங்களுக்கு தெரிந்த வகையில், பல்வேறு தவறான செய்திகளை வெளியிட்டு ஈழத்தமிழர்களை குழப்பத்தில் ஆழ்த்தி வருகின்ற இந்நிலையில், தமிழீழ மக்களின் தற்போதைய உண்மை நிலையையும், அவர்களுக்காக காத்திருக்கும் எதிர்காலம் பற்றியும் எந்தபக்கமும் சாராமல் நடுநிலைமையோடு நின்று மீள்பார்வை செய்வதற்கு இது தகுந்த நேரம் எனலாம்.

இலங்கையில் தமிழீழம் என்ற கோட்பாடு திடீரெனத் தோன்றிய ஒரு கருத்து அல்ல. ஈழத்தமிழர்கள், போர்த்துகீசியர்கள், ஒல்லாந்தர்கள் காலம் வரையும் தமது சொந்த அரசையும் (யாழ் அரசு, கோட்டை அரசு, கண்டி அரசு, வன்னி சிற்றரசு என) இறையாண்மையையும் பேணி வந்தவர்கள் என்பது சரித்திரம் அறிந்த உண்மை. ஆனால் அந்த இறையாண்மையுள்ள தமிழீழத்தின் நிலைப்பாட்டை, சிங்கள ஆதிக்க வெறி பிடித்த பேரினவாத அரசாங்கங்களிடம் நிலைநாட்டுவதற்கு அளப்பரிய தியாகம் அவசியம் என ஈழத்தின் தந்தை செல்வநாயகம் மற்றும் வி.நவரத்தினம் போன்ற தமிழீழ அரசியல்வாதிகள் பலரும் முன்பே வலியுறுத்தி இருந்தனர்.

இந்த அடிப்படையில், தமிழீழ இறையாண்மைக்காகவும், தன்மானமிக்க தமிழர்களின் எதிர்காலத்திற்காகவும் ஏறத்தாழ 33 வருடங்களாக ஆயதமேந்தி போராடி 33,000 மாவீரர்களின் உயிர்களையும் அதுமட்டுமன்றி பல ஆயிரக்கணக்கான அப்பாவித் தமிழர்களின் உயிர்களையும் தியாகம் செய்து, முள்ளிவாய்க்கால் போரின் இறுதிவரை, தங்களது ஆயுதங்களை மௌனிக்கின்ற நிலையை எடுக்கும் வரையும் விடுதலைப் புலிகளின் தலைவர் மேதகு வே.பிராபகரன் அவர்கள் அந்தக் கொள்கையை அதுவரைக்கும், சர்வதேச அரசுகளின் அழுத்தங்களையும் மீறி, தளராது வைத்திருந்ததை நாம் அறிவோம். சர்வதேச தமிழ் சமுதாயத்திடம் குறிப்பாக இளையோர்களிடம் அந்தக் கொள்கையை கையளிப்பதாக 2008 மாவீரர் நாள் உரையில் அவர் குறிப்பிட்டதை உலகமெங்கும் வாழும் எட்டு கோடித் தமிழர்கள் ஒருவரும் மறவோம்.

மேல்நோக்கிப் பார்க்கும்போது நகைப்பிற்கொத்த பிரச்சனையாகத் தோன்றினாலும், ஒரு சர்ச்சையை ஏற்படுத்தும் பிரச்சனை என்ற கோணத்தில் “புலிகள் முள்ளிவாய்க்கால் (வன்னி) யுத்தத்தில் வெற்றியடைந்திருந்தால் அவர்களது (அல்லது ஈழத்தமிழரின்) நிலை என்னவாகியிருக்கும்?” என்ற கேள்வியையும் அதன் பதிலையும் நாம் ஆராய்ந்தோமானால், பல சுவையான காரணங்களை நாம் அவதானிக்க முடியும். அதனுடன் இக்கட்டான பலகேள்விகளும் ஒன்றிற்குமேல் ஒன்றாக எழலாம்.

1.முள்ளிவாய்க்கால் போரில் விடுதலைப்புலிகள் வெற்றி ஈட்டியிருந்தால், உலகம், தமிழீழம் என ஒரு தனிநாட்டை ஏற்றிருக்குமா?
2.உலகத்தில் இயங்கும் வெளிநாட்டுச் சக்திகள் யுத்தம் முடிந்துவிட்டது என அறிந்த பின்னும் இலங்கை அரசாங்கத்திற்கு மேலும் ஆயுதம், படைகள் ஆகியவற்றை வழங்கி வருவதை நிறுத்துவார்களா?
3.உலகநாடுகள் தங்களது இலங்கைக்கான வெளியுறவுக் கொள்கையில் முண்ணுக்குப் பின்னாகப் பேசுவதுபோல் எந்த ஒரு நாடேனும், புலிகள் ஒரு விடுதலை இயக்கமே அன்றி அது பயங்கரவாத இயக்கம் அல்ல என மாற்றச் சொல்ல இயலுமா?
4.முள்ளிவாய்க்கால் போருக்கு முன்னர், தமிழர்களுக்கெதிரான இலங்கை அரசின் மனித உரிமை மீறல்களையும், இனஒழிப்பு நடவடிக்கைகளையும், இனம் கண்டு நடவடிக்கை எடுக்க உலகம் தயாரா?
பொதுவாக, மேற்கூறிய எல்லாக் கேள்விகளுக்கும் ‘இல்லை’ என்ற ஒரு வார்த்தைதான் உலக நாடுகள் அனைத்திடமிருந்தும் வரக்கூடிய பதிலாக அமையும் என்பதில் நம்மனைவருக்கும் எள்ளளவும் சந்தேகம் இராது. அப்படியே ஒரிருநாடுகள் ‘தர்மம்’ எனும் அடிப்படையில் செயற்பட எத்தனித்தாலும் அவற்றின் சுயநலம் அவ்வாறு செயற்படவிடுமா?; என்பது சந்தேகித்திற்குரியதே. உலகநாடுகளின் நீதியோ, தர்மமோ, ஒரு சிறிய நாட்டில் வசிக்கும், அழிக்கப்பட்டுக் கொண்டிருக்கும் ஒர் இனம், தனது இனத்தைக் காப்பதற்கு நிகழ்த்தும் போராட்டத்தை, அந்தக் கோணத்தில் பார்ப்பதற்குப் பதிலாக, தமது அரசியல், பொருளாதார, பூகோள ரீதியில், சுரண்டும் மனப்பான்மையுடன் நோக்குதல் என்பது காலங்காலமாக சரித்திராசிரியர்களால் எடுத்துக்காட்டப்பட்ட ஓர் உண்மையாகும். எனவே, விடுதலைப்புலிகள் முள்ளிவாய்க்கால் போரில் (அல்லது 4ம் கட்ட ஈழப்போரில்) வெற்றியடைந்திருந்தால், தமிழீழம் உருவாகியிருக்கும் என்று நாம் நினைத்திருந்தோமானால், அது உலக அரசியலை சரிவர நாம் புரிந்துக்கொள்ளவில்லை என்பதே அர்த்தமாகும். அதையே விடுதலைப் புலிகளின் தலைவர் பிரபாகரன் அவர்கள் கண்ணோட்டத்தில் பார்த்தோமானால், அப்படியான முள்ளிவாய்கால் வெற்றியானது, புலம்பெயர் சமூகத்திற்கு, அரசியல் ரீதியாகத் தமிழீழத்தைக் கோருவதற்கு, மேலுமோர் உந்துசக்தியாக மட்டுமே இருந்திருக்கும் என்றே அவர் நினைத்திருப்பார். ஆனால், வல்லரசுகள் அடங்கிய 20 நாடுகள் ஒன்று சேர்ந்து தொடுத்த போரில், பயங்கரவாதிகள் என முத்திரைக் குத்தப்பட்ட ஒரு இயக்கம் அவர்களை எதிர்த்து வெற்றி பெறுவதை அவர்கள் சகித்துக் கொள்வார்கள் என எப்படி எதிர்பார்க்க முடியும்? அவர்களின் ஆணவமும் குறுகிய மனப்பான்மையும் அதற்கு இடம் கொடுக்காது. அப்படியான வெற்றியை வைத்து அரசியல் பேச முயலும் புலம்பெயர் சமுதாயத்தின்மீதும், உலகநாடுகள் ‘பயங்கரவாத’ முத்திரையைக் குத்தி அதன் கண்ணூடாகத்தான் தமிழீழ பிரச்சினையையும் நோக்கியருப்பார்கள் என்பதில் எந்தவிதமான ஐயமும் இல்லை. நைஜீரியாவில் ‘BIAFRA’ போரின்போது நடைபெற்ற இப்படியான ஒரு சோக நிகழ்வையும் அதன் போராட்ட வரலாற்றையும் உற்று நோக்கினால், பயங்கரவாதம் என்ற சர்ச்சைகளே இல்லாத அந்த நாட்களில்கூட, உலகநாடுகள் ஒரு விடுதலைப் போராட்டத்தை எப்படி கையாண்டன என்பதே, நமக்கு தௌ;ளத்தெளிவாக பறைசாற்றும் சான்றுகளாகும்.

நாம் முள்ளிவாய்க்காலில் வெற்றியடைந்திருந்தால்.. என்ற பிரம்மையை ஒரு புறம் வைத்துவிட்டு, மீண்டும் யதார்த்த நிலையை இனி நோக்குவது பொருத்தமாயிருக்கும். இந்நிலையில் போரின் பின்விளைவுகளை அதாவது இலங்கை, இந்தியா, வெளிநாடுகள் ஆகியவற்றின் தனித்தனி நிலைப்பாடுகள் அடங்கிய மூன்று கோணங்களில் பார்க்கலாம். இக்கட்டுரையை வாசித்தபின் தமிழ் உறவுகள், தமது சொந்த அனுமானங்களைத் தடையின்றி உறுதிப்படுத்துவார்கள். அதாவது முள்ளிவாய்க்கால் போரின் முடிவு முற்றிலும் அழிவுசார்ந்ததா அல்லது அதனால் ஏதேனும் அரசியல் ரீதியான விளைவுகள் உருவாகியுள்ளனவா? எனத் தீர்மானிப்பார்கள்.

இலங்கையின் நிலைமை:

ஈழத்தமிழ் மக்களின் ஆயதப் போராட்டம் தொடங்கிய நாள் முதல், இலங்கை உலகநாடுகள் பலவற்றிடம் உதவி எதிர்பார்த்து பிச்சசைப்பாத்திரம் ஏந்தித்திரிந்தது என்பது அனைவரும் அறிந்ததே. யார் எந்த வகையில் உதவிகளை அளித்தாலும் அதை ஏற்பதே இலங்கை அரசின் கொள்கையாக இருந்து வந்ததை நாம் அறிவோம். ஆனால் இதற்கும் விடுதலைப்போராட்டத்திற்கும் என்ன சம்பந்தம் என்ற கேள்வி எழலாம். உண்மையை கூறுவோமானால், இலங்கையின் அத்தகைய நிலை, கணிசமான பலனை நீண்டகாலமாக அதற்கு கொடுத்து வந்தது என்பதே உண்மை. ஆனால் அதே நேரத்தில், உதவிகளைப் பெற்ற போதிலும், அந்த நாடுகளிடம் தனது எந்தவிதமான பிடிகளையும் கொடுக்காத வகையில் தன்னை பாதுகாத்துக் கொண்டது இலங்கை. ஆனால், யுத்தத்தின் கடைசி மாதங்களில், இவ்விதக் கட்டுப்பாட்டுக்குள் இலங்கையரசால் நடக்க முடியவில்லை. காரணம் விடுதலைப்புலிகளின் தாக்குதலின் உத்வேகம் என்பதே உண்மை. இதனால், விடுதலைப்புலிகளைச் சமாளிப்பதற்கு பெருந்தொகை கொண்ட பொருளாதார நிர்ப்பந்தத்திற்கும் நெருக்கடிக்கும் இலங்கையரசு தள்ளப்பட்டது. ஆனால், இலங்கைக்கு அத்தகைய பெருந்தொகையைச் சீனாவினால் மட்டுமே கொடுத்து உதவமுடிந்தது. இதற்கு பரிகாரமாக, ராஜபக்ஷே இலங்கை முழுவதையும் சீனாவுக்கு தாரைவார்த்துக் கொடுப்பதற்கும் தயாராக இருந்திருப்பார் என்பதே அவரது தற்போதைய போக்கு எடுத்துக்காட்டுகிறது. 25,000 க்கும் மேற்பட்ட சீனத் தொழிலாளர்களை (அல்லது படையினரை?) இலங்கைக்குள் வரவழைத்ததைவிட நமக்கு வேறென்ன உதாரணம் தேவை. இதே பாணியில், இலங்கையின் முன்னாள் சிங்கள பேரினவாத ஜனாதிபதியான ஜே.ஆர்.ஜெயவர்த்தனா, “புலிகளை வெல்வதாயின் நான் பிசாசின் உதவியைக்கூட நாடத்தயார்” என முன்னர் ஒரு முறை கூறியது ஞாபகமிருக்கலாம்.. ஆனால் வித்தியாசம் என்னவென்றால் ஜே.ஆர்.ஜே வார்த்தை ஜாலம் மட்டுமே காண்பித்து வந்தார். ஆனால் மகிந்தா ராஜபக்ஷே அதை நடைமுறையிலேயே காண்பித்துவிட்டார். எனவே, புலிகளின் போர் தந்திரம், ஈழத்தமிழ் உறவுகள் நினைப்பதுபோல் வீண்போனதும் முடிந்து போனதும் அல்ல. புலிகள் இலங்கையரசை, சீனாவின் பிடியில் தள்ளியவுடன், தமிழர்களுடைய பிரச்சினைகளை செவிமடுக்க மறுத்த எத்தனையோ நாடுகள், தமிழர்களின் பிரச்சனைகளை கேட்கவும், தீர்க்கவும் முன்வருவதை நாம் அனைவரும் பார்த்து வருகின்றோம்.

விடுதலைப்புலிகளின் போராட்டத்தினால், இலங்கை மட்டுமே ஓர் நிர்பந்தத்திற்குள் தள்ளப்படவில்லை. இந்தியாவும் அதற்கு விதிவிலக்கு அல்ல என்பதுதான் உண்மை. இந்தியாவின் காங்கிரஸ் கட்சி, அடிப்படையில், தமிழீழம் அமைக்கும் கொள்கைக்கு எதிராகவே இருந்து வருவதை நாம் அறிவோம். இலங்கையில் தமிழீழம் உருவானால், அது தமிழ் நாட்டில் பிரிவினைவாதத்தினை ஊக்குவிக்கும் என்ற தேவையற்ற பயம் இதற்கு ஒருகாரணமாய் இருந்திருக்கலாம். இந்திரா பிரதமராக இருந்தபோது, கிழக்கு பாகிஸ்தானைப் பிரித்து, வங்கதேச விடுதலைக்கு உதவியபோது, அதே வங்கமொழி பேசும் மக்களை உள்ளடக்கியதும், வங்கதேசம் பிரிவதற்கு மிகவும் உதவியாக இருந்த இந்தியநாட்டின் ஒரு மாநிலமாகவும் இருந்த மேற்குவங்கம் தனிநாடாகப் பிரிந்து போய்விடவில்லை. மேலும் தமிழ்நாட்டில், அடைந்தால் திராவிட நாடு இல்லையேல் சுடுகாடு என தனித்தமிழ்நாடு கோரிய கட்சிகள், தடைச்சட்டம் வந்ததும், 1962 களிலேயே திராவிடநாடு கோரிக்கையை சுலபமாக கைவிட்டுவிட்டனர். அதன்பின்னர், அழகு தமிழிழ், மாநிலத்தில் சுயாட்சி! மத்தியில் கூட்டாட்சி! என்று முழங்கிய போதிலும், திராவிடக் கட்சிகளால் வெற்றிபெற முடியவில்லை. கூட்டாட்சிக்குப் பதிலாக கூட்டணி ஆட்சியில் பங்குமட்டுமே பெறமுடிந்தது.

ஆரம்பக் காலத்தில் இந்தியாவின் பாதுகாப்புக் கொள்கையானது, குறுகிய கண்ணோட்டங்கள் கொண்ட தற்போதைய நிலைப்பாடு போல், எதுவும் பெரிதாகப் பாதிக்கவில்லை என்றுதான் கூறவேண்டும். இந்திராகாந்தி அம்மையார் காலத்தில் காங்கிரஸ் கட்சி இந்தியாவின் இராணுவ நிலைப்பாட்டில் மிகுந்த அக்கறையுடனும் அவதானத்துடனும் இருந்துவந்தது. இதனால் முக்கிய கேந்திர இராணுவக் கட்டுமானங்களை, சீனா, பாக்கிஸ்தான் எல்லைகளுக்கு அப்பால், தென்னிந்தியாவில் பெங்களுரில் நிறுவியதை உதாரணமாக எடுத்துக் கொள்ளலாம். ஆனால் இன்றைய நிலையில், சோனியா அம்மையாரின் கண்கானிப்பில் இருக்கும் காங்கிரஸ் கட்சியோ அல்லது இந்திய அரசாங்கமோ, சீனா, இந்தியாவின் வாசற்படிவரை வந்து நிற்பதை உணர்ந்ததாகத் தெரியவில்லை. சோனியா அம்மையாருக்கும், காங்கிரஸ் கட்சிக்கும் புலிகளை இலங்கையில் அழிப்பதில்தான் எல்லாக் கொள்கையிலும் முதன்மைபெற வேண்டிய கொள்கைபோல் அமைந்தது எனக்கூறின் அது மிகையாகாது. ஏதோவொரு வகையில், சீனாவிற்கு தலைசாய்க்கும் இலங்கையரசை காலப்போக்கில் தன்வசமாக்கலாம் என்றவொரு அசட்டு நம்பிக்கை இந்தியாவிற்கு இருந்துவருகின்றது என்றுதான் கூறவேண்டும். இலங்கையின் எல்லா எல்லைகளிலும் (கச்சைத்தீவிலும் கூட) சீனா நுழைந்ததை இந்தியாவால் விமர்சிக்கவோ கட்டுப்படுத்தவோ முடியாத நிலை உருவாகிவிட்டதே தற்போதைய அதிர்ச்சிகலந்த உண்மை. சீனாவின் இத்தகைய ஆதிக்கம், இந்தியாவிற்கு மட்டுமல்ல, இந்திய சமுத்திரத்தில் ஆர்வம் கொண்ட ஏனைய நாடுகளுக்கும் அச்சுறுத்தலாக அமைந்திருப்பதை யாராலும் மறுக்க இயலாது. இப்பிரச்சனையில், தமிழ்நாட்டில் அரசியல்வாதிகள் உட்பட பல புத்திசீவிகளின் புத்திமதிகளைக்கூட கேட்கும் நிலையில் காங்கிரஸ் கட்சி அமையவில்லை. ‘எதிரிக்கு எதிரி தனது நண்பன்’ என்கிற வட்டார வார்த்தைக்கிணங்க, புலிகளுக்கு எதிராக, இலங்கையை ஆதரிப்பதில் மட்;டுமே, இந்திய அரசின் நாட்டம் சென்றது. “தன்னுடைய மூக்குப் போனாலும் பரவாயில்லை, எதிரிக்குச் சகுனப் பிழையாக இருந்தால்போதும்” என இந்தியா கருதி வருவது மட்டுமன்றி சீனாவிலும் பார்க்க இலங்கையிடம் கூடியநட்பு வைத்தால் எல்லா பிரச்சினைகளும் தானாக தீர்ந்துவிடும் என இந்தியா நம்பி வருவதே இந்தியா செய்துவரும் வரலாற்றுப் பிழையாகும். இலங்கையை, சரித்திர ரீதியாக நாம் பார்த்தோமானால், அது ஓருபோதும், இந்தியாவை தனது நட்பு நாடாக எடுத்துக்கொள்ளவில்லை. உதாரணமாக கடந்தகாலத்தில் நடந்துமுடிந்த சீன-இந்தியப் போராக இருந்தாலும் சரி அல்லது இந்தியா-பாக்கிஸ்தான் போராக இருந்தாலும் சரி அவற்றில் இலங்கையின் ஆதரவு நிலை என்பது இந்தியாவிற்கெதிராகவே அமைந்திருந்தது இதனை எடுத்துக்காட்டும். இந்திய வம்சாவழியினராகிய மலையகத் தமிழர்களின் வாக்குரிமையை இலங்கையின் சிங்கள பேரினவாத அரசு கைப்பற்றியபோதே, இந்தியர்களுக்கும் தமிழர்களுக்கும் எதிரான கொள்கைகள், சிங்கள மக்களிடையே ஆழமாக வேறூன்றி இருந்தன என்பதை எடுத்துக்காட்டுகிறது. பின்னாளில் உருவான ஜே.வி.பி இயக்கம், இப்பகை உணர்வினை சிங்கள மக்களிடையே மேலும் வளர்த்ததை ஈழத்தமிழ் உறவுகள் நன்கறிவார்கள்..

இராஜிவ்காந்தியை ஒரு கடைநிலை இராணுவத்தினன் அடிக்க முற்பட்டதற்கும் இது அடிப்படைக் காரணம் எனலாம். இந்திய பிரதமரை அவமானப்படுத்த முயன்ற ஒருவனை தண்டிப்பதற்குப் பதில், இலங்கை அரசு, அவனுக்கு, அதன் பின்பு, பதவி உயர்வு கொடுக்கப்பட்டது என்றுகூட வதந்திகள் பரவின. இப்படியாக இந்தியாவிற்கு எதிராகவே காலங்காலமாக நடந்துவரும் இலங்கையின் நட்பை, இந்தியா எதிர்பார்ப்பது பகற்கனவாகலாம் என பல அரசியல்வாதிகள் கருதுகின்றனர். எனவே, மேற்கூறியவற்றை நாம் உற்றுநோக்கினோமானால், புலிகளை துரத்தும் வேட்டையில், இந்தியாவும் இலங்கையும் தமது சொந்தப் பாதுகாப்பு வேலிகளைத் தாமே மேய வேண்டிய நிலைக்கு தள்ளப்பட்டதை, உணரலாம்.

முள்ளிவாய்க்கால் போரின் விளைவுகள் ஈழத்தமிழருக்கு சர்வதேச சமூகத்தில் சாதகமேனும் விளைந்திருக்குமா எனப் பார்த்தால், சர்வதேச சமாதானத்தை தூக்கிப்பிடிப்பதாக கூறிக்கொள்ளும் சர்வதேச சமூகத்தின் தற்போதைய நடைமுறைகளும் அவற்றின் முன்னுக்குப் பின் முரணான நடவடிக்கைகளையும் சற்று உற்று நோக்குவோம்.

1.சர்வதேச சமூகம், தற்போது, விழிப்படைந்து மனித உரிமை மீறல்கள் இலங்கையில் நடக்கின்றன என ஒவ்வொருவராக உச்சரிக்கத் தொடங்கியுள்ளனர். அத்தோடு அதை நிரூபித்து இலங்கை அரசின் மகிந்த ராஜபக்ஷே, சரத்பொன்சேகா, கோத்தபாய ராஜபக்ஷே ஆகியோரைக் குற்றக்கூண்டில் நிறுத்துவதற்குச் சாட்சிகளைச் சேர்ப்பதிலும் ஆவலாக இருக்கின்றனர். இதன்பொருட்டு அரசியல் பிரச்சாரங்களை செய்வதோடு பத்திரிகையாளர்கள், அரசு சார்பற்ற அமைப்பாளர்கள், தனிப்பட்ட மக்கள் ஆகியோரிடமிருந்து கிடைக்கக்கூடிய சாட்சிகளையும் சேகரிக்கின்றனர்.
2.இனப்படுகொலை தடுப்பு அமைப்புகளும் தற்போது ஊக்கத்துடன் செயல்களில் இறங்க முற்பட்டுள்ளனர். இலங்கை சுதந்திரம் அடைந்தது முதல் தமிழருக்கெதிராக எடுத்த நடவடிக்கைகளை (உதாரணமாக மலையகத் தமிழரின் வாக்குரிமையை பறித்தமை, யாழ்பொதுநூல் நிலையத்தையும், வழிபாட்டுத் தலங்களையும் எரித்தமை, கல்விநிலையம், மருத்துவமனைகளை தாக்கியழித்தமை) வரிசைப்படுத்தி, இலங்கை அரசை குற்றக்கூண்டில் நிறுத்தும் பணிகளை உலகளாவிய ரீதியில் செயற்படுத்த தொடங்கியுள்ளனர்.
3.100,000 மேல் அப்பாவி பொது மக்கள் இனப்படுகொலை செய்யப்பட்டதை நாம் முறையே வெளிக்கொணர்ந்து நிருபிக்கும் பட்ஜத்தில், இச்சம்பவம் ஐ.நா.வின் சட்டப்பிரகாரம் நமக்கு சட்டமூலமாக இலங்கைத் தீவினில் இருந்து பிரிந்து தமிழிழம் அமைக்க வலுச் சேர்க்கும் என்பது நிச்சயம்.
4.இலங்கையில், முள்ளிவாய்க்காலில் இறுதிக்கட்ட போரில், ஐக்கிய நாடுகள் பிரகடனப்படுத்திய பாதுகாப்பானது என வரையறுக்கப்பட்ட இடங்களில் தாக்குதல் நடத்தி மனித உரிமை மீறல் செயல்களை புரிந்த இலங்கையை எந்தவிதத்திலேயும் கண்டிக்கத் தவறிய ஐ.நா- வின் பொதுச்செயலாளர் பான்-கி-மூன் மற்றும் அவரது ஆலோசகர் நம்பியார் ஆகியோர் மீது கூட நடவடிக்கை எடுக்க வேண்டும் எனும் எண்ணம் சர்வதேச சமூகத்தினரிடையே தற்போது வேகமாகப் பரவி வருகின்றது.
5.ஐரோப்பாவில் இலங்கைக்கு வழங்கி வந்த ஜி.எஸ்.பி வரிச்சலுகையை திரும்பப் பெறும் நடவடிக்கைகள் எடுக்கப்பட்டு வருகின்றன.
6.இவற்றோடு மட்டும் நின்றுவிடாமல், மேற்கு உலக நாடுகளுக்கும் இந்தியாவிற்குமிடையே ஓர் சிறிய இராஜதந்திர விரிசலைக்கூட முள்ளிவாய்க்கால் போர் ஏற்படுத்தியது எனக் கூறலாம். 2011-ல் நடக்கவிருக்கும் பொதுநல வாய (Common Wealth)நாடுகளின் மாநாட்டை இலங்கையில் நடத்துவதற்கு 45 நாடுகளின் ஆதரவைத் திரட்டிய இந்தியா, டிரினிடாடில் நடந்த பொதுநல வாய பிரதமரின் மாநாட்டில், வெற்றிபெற இயலவில்லை. இதனால், இந்தியா ஒரு பாரிய இராஜதந்திர பின்னடைவைச் சந்திக்க நேர்ந்தது. காரணம் பிரித்தானியா, கனடா, ஆஸ்திரேலியா, நியூசிலாந்து ஆகிய நாடுகள் இலங்கை ஓர் போர்க் குற்றம் நடத்திய நாடு என்ற வகையில் இம்மாநாட்டை அங்கு நடத்த முடியாது என உறுதியாகவும் கடுமையாகவும் ஆட்சேபித்தனர். இதனால் இம்மாநாடு இலங்கையிலிருந்து அகற்றப்பட்டு ஆஸ்திரேலியாவிற்கு கொண்டு செல்லப்பட்டது. இது புலம்பெயர்வாழ் ஈழத்தமிழரின் இடைவிடாத அழுத்தத்தினால் விளைந்த பலன்களில் ஒன்று எனக் கூறலாம்.
7.இந்தியா, இலங்கையின் அரசியலில் தலையிட்டதால் அடைந்த பின்னடைவு மேற்கூறிய பிரச்சனையுடன் முடிந்துவிட்டது என்று நாம் நினைத்துக்கொண்டிருக்கும் வேளையில் இலங்கையில் நடைபெற்ற மனித உரிமை மீறல்களுக்கும் இனப்படுகொலைகளுக்கும் நேர்முகமாகவும் மறைமுகமாகவும் உதவி செய்த வகையில், இந்தியாவும் ஒரு காரணகர்த்தா ஆகலாம் என்ற இன்னொரு குற்றப்பத்திரிகையும் உலகநாடுகளிடமிருந்து பெறவேண்டிவருமோ என அனுபவம் மிகுந்த அரசியல் ஆய்வாளர்கள் அஞ்சுகின்றனர். இப்பிரச்சினை உலக அரசியல் அரங்கில் வெளிக்கொணரப்பட்டால், இந்திய அரசுக்கு ஒரு இராஜதந்திர பின்னடைவையும் அல்லாது அத்தோடு காங்கிரஸ் கட்சியின் அரசியல் வரலாற்றின் அந்திமத்தையும் உருவாக்கக்கூடும். எனினும், இம்முயற்சியின் பெறுபேறு புலம்பெயர்வாழ் தமிழ் மக்களிடத்தும் மற்றும் தமிழ் நாட்டு மக்களிடத்தும் தங்கி உள்ளது.
8.எல்லாவற்றிற்கும் மேலாக, தமிழீழத்தை ஜனநாயக ரீதியில் அமைக்கும் பொறுப்பு புலம்பெயர் சமூகத்திடம் கையளிக்கப்பட்டுள்ளது. “புலிகள் அழிந்து விட்டார்கள்” என சிறிலங்கா அரசே கொக்கரிக்கும் நிலையில், இனிமேல் வெளிநாட்டு அரசுகள் “பயங்கரவாதம்” எனும் வாதத்தை தமிழ் மக்கள் மீதோ அல்லது தமிழீழம் கோரும் அமைப்புகள் மீதோ கொண்டுவர முடியாது. அத்தோடு மனித உரிமை மீறல்களையும் இன ஒழிப்பு நடவடிக்கைகளையும் தொடர்ந்து நடத்தும் ஓர் அரசின்கீழ் அல்லது அரசுடன் தமிழ் மக்கள் இனிமேலும் ஒருங்கிணைந்து வாழ முடியாது என்பதும், இறந்தவர்களுக்கு மரியாதை செலுத்துவது என்பது உலகில் ஒரு பண்பாகக் கடைபிடிக்கும் நாளில், இன்று சிங்கள இனவெறி அரசானது இனஅழிப்புக் கொள்கையின் ஒரு திட்டமாக மாவீரர் துயிலும் இல்லங்களை புல்டோசர்களால் தகர்த்து எறிந்திருப்பதிலிருந்து ஐயமின்றி நிருபணம் ஆகிவிட்டது என்று, கடல்கடந்து வாழும் ஈழத்தமிழர்கள் அனைவரும் ஜனநாயக வழியில் தமது தமிழீழ இலட்சிய வேட்கையை வெளிப்படுத்தத் தொடங்கிவிட்டனர். தமிழீழம் ஒன்றே தமது தீர்க்கமான முடிவு என (1976-ல் முன்மொழியப்பட்டு 1977 இலங்கைப் பொதுத்தேர்தலின் மூலம் உறுதி செய்யப்பட்ட வட்டுக்கோட்டை தீர்மானத்தின் அடிப்படையில்) உலகத் தமிழ் மக்கள் ஒருமித்து நிற்கின்றனர். இன்று பிரான்சு, நார்வே, கனடா ஆகிய நாடுகளில் பொதுவாக்கெடுப்பு (கருத்துக்கணிப்பு) மூலம் 99மூ தமது ஆதரவுக் குரலை எழுப்பி உள்ளனர். பிரித்தானியா, ஜெர்மனி உட்பட ஏனைய நாடுகளும் இதே வழியில் பின்செல்ல அணிவகுத்து நிற்கின்றன. “ஜனநாயக வழியை பின்பற்ற வேண்டும்” எனக் கொக்கரிக்கும் இந்தியா மற்றும் மேற்கு நாடுகளுக்கு இந்நடவடிக்கை ஓர் கண்திறப்பாக அமையும். அதுமட்டுமல்லாது தமிழ் மக்கள்மீது தரங்குறைந்த அரைகுறைத் தீர்வுகளை திணிக்க யோசிக்கும் அரசியல்வாதிகளுக்கு இத்தகைய நடவடிக்கை ஒரு சம்மட்டி அடியாக அமையும் என்பதில் ஐயமில்லை.
மேற்பட்ட கருத்துகளை நோக்கின், முள்ளிவாய்க்கால் போரில் தமிழினத்திற்கு பல நன்மைகள் ஏற்பட்டிருக்கின்றன என ஓருவர் கருதினாலும், முள்ளிவாய்க்கால் யுத்தத்தினால் ஏற்பட்ட பாரிய மனித இழப்புக்களையும், 300,000 க்கும் மேற்பட்ட தமிழ் மக்கள் முள்வேலிகளின்பின் பட்ட வதைகளையும், அவலங்களையும், என்றும் எவராலும் ஈடு செய்ய முடியாது என்பது கசப்பான உண்மை. எந்தப் போரிலும் மனித உயிரிழப்பு ஓர் தடுக்க முடியாத அம்சம் என சிலர் ஆறதல் அடையக்கூடும். ஆனாலும் இன்னும் இராணுவச் சித்திரவதைக்குள் உட்பட்டிருக்கும் பல்லாயிரம் போராளிகளின் எதிர்காலம் மிகப்பெரிய கேள்விக்குறியாக்கப்பட்டிருப்பது அலட்சியப்படுத்தக்கூடிய பிரச்சனையல்ல.

எனவே, ஈழத்தமிழ் உறவுகள் மேற்கூறிய பிரச்சனைகளை ஆராய்ந்து உணர்ச்சிவசப்படாத வகையில் ஓர் அமைதியான முடிவுக்கு வருவார்கள் என நம்பிக்கையுடன் இக்கட்டுரையை முடிக்கின்றேன். இதை எழுதும்போது ஆங்கிலத்தில் ஒரு பழமொழி நினைவிற்கு வருகின்றது “every cloud has a silver lining” அதாவது எந்த கருமேகத்தையும் ஒரு வெள்ளி மின்னல்கீறு சூழ்ந்து இருக்கும் என்பதே அதன் விளக்கமாகும்.
